Congressional Report

Pursuant to the Consolidated Appropriations Act, 2012 conference report provision regarding “Judgment Fund Transparency,” the following report on Fiscal Year 2011 payments is provided.

In this report, Judgment Fund payments are categorized as either Administrative or Litigative. Administrative payments are for certain claims settled by agencies without involvement from the Department of Justice (DOJ). Litigative payments are for claims that involved DOJ as representative of the defendant agency. Litigative payments include payments resulting from a settlement with the claimant before or during litigation as well as those resulting from a judge’s order.

The report is sorted alphabetically by the Defendant Agency Name. The fields displayed in the report are as follows:

  • Defendant Agency Name – The agency against which the claim was filed.
  • Control Number – Internal tracking number assigned by FMS.
  • Plaintiff's Counsel – Legal representative for the plaintiff or claimant. This field is optional and is not always provided by the submitting agency in part because not every claimant has legal representation.
  • Payment Sent Date – The date payment was issued by FMS.
  • Payment Amount – Total amount paid to the claimant. This will include some or all of the following components: principal, attorney fees, costs, and interest.
  • Principal Amount – Amount, if any, awarded except for costs, interest or attorney fees.
  • Principal Citation Code – Legal statute under which the U.S. is liable and amount is payable by the Judgment Fund.
  • Principal Citation Code Description – Brief description of the legal statute resulting in payment of principal.
  • Attorney Fees Amount – Amount, if any, specifically identified as attorney fees.
  • Attorney Fees Citation Code – Legal statute under which the U.S. is liable and amount of attorney fees is payable by the Judgment Fund.
  • Attorney Fees Citation Code Description – Brief description of the legal statute resulting in payment of attorney fees.
  • Cost Amount – Amount, if any, awarded as costs.
  • Cost Citation Code – Legal statute under which the U.S. is liable and amount of costs is payable by the Judgment Fund (Typically 28 USC 1920).
  • Cost Citation Code Description – Brief description of the legal statute resulting in payment of costs.
  • Interest Amount – Amount, if any, awarded as interest on principal.
  • Interest Citation Code – Legal statute under which the U.S. is liable and amount of interest on the principal is payable by the Judgment Fund.
  • Interest Citation Code Description – Brief description of the legal statute resulting in payment of interest.
